Terms of Service

Revised 12 October 2026

This is a draft. The highlighted details are still being confirmed and will be filled in before it takes effect.

1. Acceptance, eligibility and accounts

These Terms of Service ("Terms") form a binding agreement between you and [Company Legal Name] ("FixPoint", "we", "us"), CIN [CIN], registered at [Registered Office Address]. They govern your use of the FixPoint website, the FixPoint Drive apps, the Drishti Intelligence device, the FixPoint Card and all related services (the "Services").

By creating an account, buying a device or using the Services, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Services. These Terms are an electronic record under the Information Technology Act, 2000 and need no physical signature.

Eligibility. You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872. Learners under 18 may use Learning Center courses only through a parent or guardian's account. If you use the Services for a business, you confirm you are authorised to bind that business.

Your account. You must give accurate information and verify your mobile number by OTP. You are responsible for all activity on your account and for keeping your login and OTPs secret. Tell us immediately at [support@fixpoint.in] if you suspect unauthorised access.

Modules. Some features are optional and can be enabled or disabled. Features may differ by region, vehicle type and plan, and some may be offered in beta.

2. Vehicles, documents and your responsibilities

You may add only vehicles you own, are authorised to manage, or operate under a valid lease, rental or employment arrangement. Adding someone else's vehicle without authority is prohibited and may be reported to the authorities.

  • Accuracy of records. Vehicle details are fetched from VAHAN, Parivahan and other sources. We do not guarantee that government or third-party data is complete, current or error-free. Check important details against official records.
  • Document Vault. Digital copies stored in FixPoint are for your convenience. They do not replace documents you are legally required to carry or produce, unless they are held in a form recognised by law, such as DigiLocker or mParivahan.
  • Reminders. Renewal, PUC, tax, service and challan reminders are a courtesy. You remain responsible for meeting every legal deadline, even if a reminder is late or not sent.
  • Valuations and calculators. Net worth, depreciation, EMI, fuel, toll, insurance-premium and total-cost-of-ownership figures are estimates for guidance. They are not offers, quotes or financial advice.
  • Status tags. Marking a vehicle as Stolen, Scrapped or Under Legal Hold in FixPoint does not report it to any authority. You must file FIRs, insurance claims and RTO applications through the proper channels.

3. Marketplace and third-party services

FixPoint is a technology platform that connects you with independent providers. Unless we say otherwise for a specific product, the provider, not FixPoint, sells and performs the service and is responsible for it.

  • Insurance. Insurance products are offered by licensed insurers and distributed through [FixPoint's IRDAI registration / partner intermediary name and licence no.]. Quotes, claim ratios and AI recommendations are indicative. The policy wording issued by the insurer governs coverage, exclusions and claims.
  • Government services. RTO, e-challan, FASTag and VAHAN services are provided by government bodies and authorised issuers. Government fees, processing times and outcomes are set by those authorities. Our convenience or agent fee, where charged, is shown separately before you pay. We are not a government body and cannot guarantee approval.
  • Service bookings, parts and dealers. Service centres, parts sellers and dealers set their own prices, warranties and return policies. OEM versus aftermarket comparisons and dealer offers are based on information they provide and can change.
  • Parts Verifier. Authenticity results are probabilistic estimates based on codes, QR data and images. A "genuine" or "fake" result is not a certification or warranty. Confirm with the manufacturer before relying on it for safety-critical parts.
  • Arena Studio. AI previews are illustrations. Real parts, finishes and performance may differ. Modifications may affect your warranty, insurance and road legality under the Motor Vehicles Act, 1988, and you are responsible for compliance.
  • TestBeforeBuy. Prices, specifications and discounts come from OEMs and dealers and may change without notice. Test drives are conducted under the dealer's terms.
  • Driver On Demand and instructors. Drivers and instructors are independent professionals, not FixPoint employees. We run background checks on drivers shown as "Verified", but cannot guarantee their conduct. You must provide a roadworthy, insured vehicle with valid documents.

If you have a problem with a provider, contact us and we will help you raise it with them.

4. Drishti Intelligence device

The Drishti device is sold or leased under these Terms and the warranty card supplied with it.

  • Installation. Plug the device into a compatible OBD-II port only. Do not install or adjust it while driving. Some vehicles, especially older or two-wheeler models, may not be compatible.
  • Predictions and alerts. Diagnostics, health scores and 45-day maintenance predictions are estimates. They can miss faults or raise false alarms. Do not ignore warning lights, unusual sounds or a mechanic's advice because the app shows no alert.
  • Remote lock and engine disable. Use these controls only on vehicles you own or are authorised to control, and only when the vehicle is stationary or safe to stop. Never disable a moving vehicle. You are responsible for any harm caused by misuse.
  • Tracking others. You must not use GPS tracking, geo-fencing or time-fencing to monitor any person without their knowledge and any consent the law requires.
  • Connectivity. Tracking, alerts and the hotspot depend on mobile networks, GPS and power. They may be unavailable in some areas or if the device is disconnected.
  • Warranty and returns. The device carries a [12]-month limited warranty against manufacturing defects. Damage from tampering, wrong installation, water or accidents is not covered. Return and refund terms are set out in our [Refund Policy].
  • Vehicle warranty. Fitting any aftermarket device may affect your vehicle manufacturer's warranty. Check with your dealer before installing.

5. Emergency SOS

Emergency SOS helps you reach help faster, but it is not an emergency service and does not replace one.

  • In any emergency, call 112 (or 102 / 108 for an ambulance) directly. The in-app call buttons connect you to these public numbers; FixPoint does not operate them.
  • Guided accident flows, medical prompts and international assistance are general guidance, not medical or legal advice.
  • SOS depends on your phone, battery, network and location services. Messages, calls or location sharing may fail or be delayed.
  • Towing, roadside assistance, legal, translation and vehicle-shipping help is provided by third parties and may not be available in every location or at every time.
  • Starting an insurance claim from the SOS screen sends your report to the insurer. The insurer alone decides the claim.

To the extent permitted by law, FixPoint is not liable for any delay or failure of emergency response caused by factors outside our reasonable control.

6. Fleet accounts, payments, membership and rewards

Commercial fleet accounts. Fleet operators are responsible for their drivers, rental customers and business records. You must have a lawful basis, and give notice to drivers, before tracking their location or driving behaviour. Invoices generated in FixPoint are templates; you are responsible for their accuracy and for GST and other tax compliance.

Payments. Prices are shown in Indian Rupees and include or show GST as applicable. Payments are processed by authorised payment gateways. Government fees, insurance premiums and FASTag recharges are passed to the relevant authority or provider and are refundable only under their rules. Refunds for FixPoint's own products and fees follow our [Refund and Cancellation Policy].

Membership and FixPoint Card. Membership plans, their benefits and fees are described on the plan page at the time of purchase. Paid plans renew automatically unless you cancel before the renewal date. The FixPoint Card remains our property, is non-transferable and may be cancelled if the account is closed or misused.

Points. FixPoint reward points have no cash value, cannot be transferred or sold, and may expire as stated in the rewards rules. We may adjust or cancel points earned through fraud, errors or misuse. Points earned for driving behaviour are based on Drishti data and our scoring method, which we may change. We may change the rewards programme with reasonable notice.

7. Acceptable use, your content and intellectual property

You must not:

  • add vehicles, documents or personal data you have no right to use, or impersonate another person;
  • upload forged, altered or misleading documents, or use FixPoint to evade challans, taxes or legal proceedings;
  • track, stalk or harass anyone using location, geo-fencing or remote-control features;
  • post abusive, defamatory, obscene or unlawful content in reviews, communities or Q&A;
  • scrape, copy, reverse-engineer, overload or interfere with the Services, the Drishti firmware or our APIs;
  • manipulate reviews, ratings or reward points, or create fake accounts or bookings;
  • use the Services in breach of the Motor Vehicles Act, 1988, the Information Technology Act, 2000 or any other law.

Your content. You keep ownership of the documents, photos, reviews and other content you upload. You give FixPoint a non-exclusive, royalty-free licence to store, process and display that content only to provide and improve the Services, as described in our Privacy Policy. Public content such as reviews and community posts may be seen by other users.

Our intellectual property. The FixPoint, Drishti and Arena Studio names, logos, software, designs and content belong to FixPoint or its licensors. We give you a limited, personal, revocable, non-transferable licence to use the Services for their intended purpose. Logos you upload to Arena Studio must be yours or used with permission.

Takedowns. To report content that infringes your rights or breaks the law, write to our Grievance Officer. We will act on valid complaints within the timelines required by the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

8. Disclaimers, liability and indemnity

Disclaimers. The Services are provided "as is" and "as available". To the extent permitted by law, we do not warrant that they will be uninterrupted, error-free or that AI outputs, predictions, valuations, prices or third-party data will be accurate. Nothing in the Services is professional mechanical, legal, medical, insurance or financial advice.

Limitation of liability. To the extent permitted by law:

  • FixPoint is not liable for indirect, incidental, special or consequential losses, including lost profits, lost data or business interruption;
  • FixPoint is not liable for acts or omissions of insurers, government bodies, service centres, sellers, dealers, drivers, instructors or other third parties;
  • our total liability for any claim relating to the Services is limited to the greater of the amount you paid FixPoint in the 12 months before the claim, or ₹[5,000].

Nothing in these Terms limits liability that cannot be limited under Indian law, including for fraud, or for death or personal injury caused by our negligence, or your rights under the Consumer Protection Act, 2019.

Indemnity. You agree to compensate FixPoint for losses, claims and reasonable legal costs arising from your breach of these Terms, your misuse of tracking or remote-control features, or your violation of any law or third-party right.

9. Termination, governing law and contact

Termination. You may close your account at any time from Settings. We may suspend or close your account, or stop a feature, if you breach these Terms, if required by law, or to protect users or the Services. We will give notice where reasonably possible. Sections on payments due, content licences, disclaimers, liability, indemnity and disputes survive termination.

Changes. We may update these Terms. We will post the revised version with a new date and notify you of material changes at least [15] days before they take effect. Continuing to use the Services after that date means you accept the changes.

Governing law and disputes. These Terms are governed by the laws of India. We encourage you to contact us first so we can try to resolve any issue informally within 30 days. Subject to that, and to your right to approach a consumer commission under the Consumer Protection Act, 2019, the courts at [City, State] have exclusive jurisdiction.

General. If any part of these Terms is found unenforceable, the rest remains in force. Our failure to enforce a right is not a waiver. You may not transfer your rights under these Terms; we may transfer ours to a successor business.
